General Terms and Conditions of KBL PLAY
Please read the following Terms of Access ("Terms of Access") carefully before registering on, accessing, browsing, downloading or using KBL portal, which can be accessed via KBL PLAY APP named KBL mobile application, KBL PLAY website, android stores and such other locations as uploaded (hereinafter collectively, KBL Platform) and run by KBL.
For the avoidance of doubt, it is clarified that these terms and conditions shall apply to all services which means games and offers, deals and redemption services provided by KBL ("KBL Offerings"). All Services are rendered by KBL PLAY through the KBL PLAY Platform under the brand name “KBL PLAY”.
These Terms of Access and all supplemental terms, as amended from time to time, govern your use of any KBL PLAY Offerings or KBL PLAY account to access, install or play offered by KBL PLAY or any of its subsidiaries, affiliates and technology partners on personal computers, laptops, tablets and/or mobile devices.

These Terms of Access, as well as KBL PLAY Privacy Policy available https://kblplay.club (Incorporated herein by reference) form legally binding contract between You and KBL PLAY. By using KBL PLAY Platform, you affirm that you are competent to review and agree with the Agreement and that you have reviewed this Agreement and take full responsibility for your compliance with them.
Modification of these Terms of Access
KBL PLAY reserves the right to change, modify, add, or remove portions of this Terms of Access (each, a change and collectively, changes) or the contest/campaign at any time by posting notification on the KBL PLAY Platform or otherwise communicating the notification to You. The changes will become effective immediately on a going-forward basis with respect to Your use of the KBL PLAY Platform, availing the KBL PLAY Offerings. If You do not agree with any such change, your sole and exclusive remedy is to terminate Your use of the KBL PLAY Offerings/KBL PLAY Platform. Your continued use of the KBL PLAY Platform following the posting of changes constitutes your agreement to all such terms, conditions, and notices. You are responsible for regularly reviewing these Terms of Service and additional terms posted on the KBL PLAY Platform.

Accessing KBL PLAY
By accessing or using KBL PLAY Offerings, including browsing via KBL PLAY website or through any other mobile application, you accept and agree to these terms of KBL PLAY Offerings and the Privacy Policy. You may also be required to register an account on the Service (an "Account"). You warrant that you are not prohibited from receiving products, including services or software. You are responsible for any fees, including internet connection or mobile fees that You incur when accessing the KBL PLAY.
Account Creation and Information
To use our services, you will need to register with us. We may require You to create an account for KBL PLAY Offerings with us with Username and Password on KBL PLAY Platform or at any other website or platform. While creating the account You may be required to provide KBL PLAY with certain personal information, which may include your name, birth date, e-mail address, address and, in some cases payment information. This information will be held and used in accordance with KBL PLAY Privacy Policy and relevant notices / policies, if any, provided at the point of information collection or use. Additionally for verification purposes we may require you to authenticate your account with KBL PLAY and have access to details for paid services. You must provide the correct details in all fields and keep the details updated including and not limited to your personal information like postal address, email address, telephone number(s) etc. Any discrepancy in the KYC or other mandatory requirements shall make you ineligible for winnings, unless and until the same is updated.

In case if we feel to have some background checking, then we may, at any time, require you to provide us with additional documentation and proofs to verify the correctness of this information, failing which we reserve the right to hold / suspend or terminate your registration.
You understand and agree that deposits in your user account maintained with us are purely for the purpose of participation in cash module of games available at KBL PLAY Offerings and neither can you transfer any sum from your user account to any other account nor withdraw the same except as may be permitted by us and based on the conditions as may be prescribed from time to time.
Additionally, we might be conducting certain promotional activities through which rewards by way of bonus are issued. We may gratuitously issue bonus to you for the purpose of participation in games or for other programs which we conduct routinely within our platform. All the bonuses will be credited in your bonus account (hereinafter referred to as “Bonus Account) and which can be used within the Platform, subject to the terms governing usage of Bonus Account.
Game Rules
Registered Player should be at least 18 years of age and an individual user of the KBL PLAY Platform & also Indian citizen. You agree that these terms constitute an agreement ("Agreement") between You and KBL PLAY and if additional terms and/or agreements apply to the KBL PLAY(s) used by You, those additional terms and/or agreements shall govern on your use of KBL PLAY Offerings as well.
If user has violated our Policy, We suspending/terminating their account on the KBL PLAY app.
We do not allow users below 18 years of age to play games on the KBL PLAY app.
We don't permit hacking in any structure, including utilizing bugs, outsider instruments or different records to get to the KBL PLAY application, and such conduct will prompt the user being prohibited from the KBL PLAY application.

Use of Service

You shall not create an account using a false identity or information, or on behalf of someone other than yourself;
>You shall not have an account or use the service if you have previously been removed by KBL PLAY or previously been banned from playing any Games on KBL PLAY Platform, and we at our sole discretion may allow You to create/reopen such account;
If You are resident (permanent/temporary) of any state/union territory within the territory of India which disallows you from participation, then You shall not be entitled to participate in the KBL PLAY Offerings in our Portal, wherever such KBL PLAY is prohibited by applicable law as per the State/ Union Territory notifications / regulations in force now as per Annexure I and/or which may come in future. In short, participation in online games or contests or campaigns shall be controlled by your residential status and statutory regulations present in your state and please restraint or contact us, before enrolling from notified areas;
Use our services only for yourself and not on behalf of any other person or entity;
Use the KBL PLAY Platform only in accordance with the law and within the legal jurisdiction in which you are a resident. It shall be your sole responsibility to ensure compliance with the laws of your jurisdiction before registering to play the Games, using KBL PLAY or entering any competition offered on KBL PLAY Platform.
Termination and Suspension
KBL PLAY may terminate or suspend your access to the Services and delete any accounts at any time, for any reason. Your rights to use the Services will terminate immediately. You are responsible for making sure that your use of the Services complies with these Terms of Access, any applicable law, and any additional terms and agreements. If KBL PLAY PLAY PLAY PLAY terminates or suspends your access, you will not be entitled to any refund or compensation, and you may be banned from using the Services in the future.
Funds, Payments, Prizes, and Withdrawals
All payments must be made through the payment methods provided by us. You agree to pay all fees and charges incurred in connection with your account.
Prizes will be credited to your account and can be withdrawn subject to our withdrawal policy.
We reserve the right to withhold or deduct any prizes or payments if we believe that any fraudulent activity or violation of these terms has occurred.

Dispute Resolution
The courts of competent jurisdiction at Chandrapur, Maharashtra shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Application or the Services provided by us, the construction, validity, interpretation and enforceability of these Terms, or your or our rights and obligations, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below.
In the event of any legal dispute (which may be a legal issue or question) which may arise, firstly the party raising the dispute shall provide a written notification ("Notification") to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration.
The place of arbitration shall be Chandrapur, Maharashtra India by a sole arbitrator who shall be appointed by us and whose decision shall be final and binding upon all the parties. All arbitration proceedings shall be conducted in Hindi and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
Nothing contained in these Terms shall prevent us from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard our interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on our part to pursue any remedy for monetary damages through the arbitration described herein.
You agree that any cause of action arising out of Your use of the Platform/Services/Application must be commenced within 3 (three) months after the cause of action accrues or You become aware of the facts giving rise to the cause of action, whichever is later. Otherwise, such cause of action shall be permanently barred.
